    This curricular unit aims to explain the close and necessary relationship between communication and law, alerting doctoral students to the main branches of law to take into consideration for compliance with and respect for the legal rules in force, essential for adequate and structured communication in a rule of law. Doctoral students must be able to make the co-relationship between Law and Communication, and must know the rights and obligations implicit in Communication, identifying possible legal violations in order to actively and diligently avoid them in different areas of law.

    Program contents: 1. Relationship between communication and law: branches of law to take into consideration 2. Practical applicability of law in communication projects 3. Personality rights and their particularities 4. Freedom of expression and its limits 5. Respect for copyright and respect for the protected work 6. The free use of works under article 75 of the CDADC as a limit to copyright: critical analysis 7. Authorship and ownership of works 8. Orphan works and their problems 9. Abusive use of works and its civil, administrative and criminal consequences 10. Works subject to Creative Commons and Open Access licenses – rules for legal use 11. Respect for the General Data Protection Regime and its implications

    Objectives

    At the end of the curricular unit, doctoral students should be able to recognize the importance of Law in Communication; know the rights and duties that must be respected; correctly identify the concept of freedom of expression and its legal manifestations; recognize the importance of personality rights and their limitations; know how to respect copyright and protected work; know the exceptional situations of free use of works as a limit to copyright; identify orphan works and their problems; recognize the consequences of the abusive use of protected works in all its aspects; recognize works subject to Creative Commons and Open Access licenses and the rules for their lawful use, know and apply the data protection rules, identifying and correctly interpreting the General Data Protection Regime.
  • Teaching methodologies and assessment

    Teaching methodologies and assessment

    The methodologies to be used during the teaching of the Curricular Unit involve the use of the expository and demonstrative method. Various brainstorming sessions will be carried out, as well as analysis of practical situations, namely jurisprudential decisions from higher courts. This analysis of real situations will allow for active discussion of the topics to be addressed, and reflection that will stimulate critical-legal thinking, which proves to be essential for students in the third cycle of studies in Communication and Activism.
