This curricular unit endeavours exploring the Western experience of Law related with the macroscopic perspective of collective identity (and its specifying contexts) from the perspective which contemporary juridical discourse (admitting diverse concepts of Law and the projection of heterogenous theories of Justice) effectively allows, with a specific concentration on some of the decisive problems of our time (multicultural fragmentation, terrorism, the challenges of artificial intelligence, the ethics of the politically correct, the holistic continuum of biological neoecology, the pandemic experience, the reinterpretation of confinement and exile)

Syllabus
The starting point: the "grid" concerning the binomial coomunitas/societas. Cap. I/ The concept of societas autonomously introduced in the modern cycle and its projection in contemporary legal thinking: the social contract trend concentrated on its peak (Rousseau); the arguments of Kant and Bentham; the legacy of 19th century¿s reinvention of dialectics (from Hegel and Marx to the successive generations of the Frankfurt school); the conceptions of societas privileged by critical rationalism and by autopoietic functionalism; the Rawls/Habermas counterpoint; the proposals of economic pragmatism. Cap. II/ The return of community: the reinvention of practical philosophy (hermeneutics as philosophy, argumentation as a form of life); the communitarian approach; Deconstruction as philosophy; the return of natural law tradition. Cap III/The experience of law from the perspective of the constitutive dialectics between society and community: some exemplary problems.

Objectives
Objectives
This seminar endeavors to make accessible to the students some thematic kernels which contemporary legal philosophy and social philosophy (mostly when they intersect) privilege , whilst assuring that the criteria of this intersection concern the relevance and visibility of the involved issues. The aim is providing resources in order to reflect autonomously about the problem of the civilizational and cultural crisis which wounds several social institutions, whilst simultaneously understanding that Law¿s answer, as a culturally possible one, is inevitably affected by this crisis.
