I. Introduction: Political and economic foundations of Competition Law. Competition Law in Portugal and in the EU II. The Portuguese Competition Law: comparative analysis with the competition regime in the TFEU. III. Competition Law in the EU- The competition rules in the TFEU. Rules applicable to undertakings: Articles 101 and 102 of the CJEU. Rules applicable to States: public undertakings and undertakings with special or exclusive rights; Article 106 of the TFEU and the particular case of SGEIs. Restrictive practices; Justification of agreements, concerted practices and decisions of associations of undertakings: notion of dominant position and abuse of economic dependence. Merger Control. Public aids. IV- The Portuguese Legal System: The Competition Authority (PCA). Specificities: Sanctionary procedure; Powers of PCA; Precautionary measures. Regulatory Procedure. Objectives
Learning objectives: 1) Knowledge acquisition on competition law, at the national and European dimension; 2) Field of technical-legal and economic concepts underlying the application of competition law, in order to encourage the study and research in this area in its specialized legal double strand, national and European; 3) Develope the capability of solving practical cases through the study of specific cases; 4) Study and understanding of the role of AdC and their concerted intervention with the other sectorial regulatory Authorities; 5) Field of preventive and sanctioning procedural procedures provided for legally in defense of competition; 6) Acquisition of knowledge about the regulation of markets and competition defense, a complex, comprehensive and multidisciplinary approach of national and European legislative instruments most relevant.
