The UC comprises the study of essential themes of criminal law, from the perspective of Portuguese legislation and comparative law, analysing them from the angle, both theoretical-dogmatic and practical-jurisprudential – a circumstance that gives it fundamental importance in the context of a PhD course in law.

Syllabus
– The society of risk, the rule of law and the criminal justice of the "fact". The essential function of the concept of legal good. – The meaning of the penal norm and the material concept of crime. The teleological understanding of the general theory of crime and its projections in "classical" criminal law and in the specialized spheres of the so-called "secondary" criminal law. – The opposition of the unlawful act (= fact) to guilt as a core issue of criminal rights of continental tradition. – Monographic themes: theory of error, paradigms of justification, objective imputation, forms of crime, criminal liability of collective entities.

Objectives
General overview of the nowadays doctrine on the studied themes. Analysis of the theoretical and dogmatic basis of those themes and its projections on legal regulation and jurisprudential solutions. Promotion of an autonomous reflection on Criminal Law’s central problems, providing the skills needed for the proper performance of legal professions and research.
